Requirements

Basic Requirements:

- To invite a foreign national to the U.S. for a training/internship at your company,
he or she must first be accepted by an officially designated organization that will help

trainee/intern must obtain a Certificate of Eligibility from a U.S. Department of
State-designated sponsor to obtain the J-1 Visa.

- The Host Company may not use the J-1 trainee/intern to fill the position of a part-
time or full-time staff member and/or to immigrate to the U.S. – it is against the law.
J-1 trainees/interns may not make final decisions about, or carry the full
responsibility for, major tasks, assignments or projects. However, they may provide
assistance in these matters since on-the-job training is encouraged as an

- The Host Company must provide the trainee with a structured training program that
is both suitable to the trainee/intern’s qualifications and background.
